Attorney General Merrick Garland has decided to contest the Order by Trump’s handpicked judge, Aileen Cannon. Specifically, Garland is asking the Judge Cannon to rescind her order for a Special Master to review the batch of documents that the FBI seized when they executed a search warrant on Mar-a-Largo. Garland’s motion to Judge Cannon points out that the seized documents are not Trump’s and thus, it makes no sense for a Special Master to review them to see if they are subject to privilege. Second, the Garland is asking that Judge Cannon withdraw her order for the FBI to stop any criminal investigation related to the seized documents. If Judge Cannon does not rescind these orders, Garland will appeal Judge Cannon’s decision.
Many legal observers doubted that Garland would contest Judge Cannon’s order because it might delay the investigation. But Garland has decided to play hardball. It seems Garland is planning to indict Trump (if the law and the evidence warrants it). And, if Trump is going to win this one, it will be after combat, not forfeit.
